The Conveyancing Procedure

Once we have been instructed, our conveyancing solicitors will issue you with our Client Care Letter which will set out the terms of our engagement and will set out our initial requirements and will enclose a Property Information Form, Fittings and Contents Form and Leasehold Information Form is applicable.

Whilst we await for you to return your completed paperwork, we will obtain details of your Property’s legal title from HM Land Registry.

Once you have returned your completed paperwork, we will issue a Contract and supporting documentation to the Purchaser’s Solicitor.

The Purchaser’s Solicitor will review the Contract paperwork and will forward their enquiries to us, if required. They will also carry out Local Authority, Environmental and Water and Drainage Searches.

Once the Purchaser’s Solicitor has received the results of their Searches and have received the Purchaser’s Mortgage Offer and are satisfied with our replies to enquiries, the will request the Purchaser to pay their Deposit and sign the Contract in readiness for exchange of contracts.

The exchange of contracts is a telephone call between the Seller’s and Purchaser’s Solicitor in which each agree that the Seller and Purchaser should be committed to the sale/purchase and a completion date is agreed.

On the day of completion, you must vacate the Property, usually by 2pm. Your mortgage, if any, will be repaid, our costs, including the Estate Agent’s fees will be paid and any balance paid to you. We have additional conveyancing tips here.

PURCHASE TRANSACTIONS

Once we have been instructed, we will issue you with our Client Care Letter which will set out the terms of our engagement and will set out our initial requirements.

Your Mortgage Lender, if any, will carry out a Valuation and you will need to have an appropriate Survey to be carried out.

We will contact the Seller’s Solicitor to obtain the Contract and supporting paperwork.

Once we have received the Contract and supporting paperwork, we shall review the same and raise any necessary enquiries with the Seller’s Solicitor and carry out all appropriate searches.

Once we have received replies to our enquiries; Search results and your Mortgage Offer, we will arrange for you to sign the Contract and discuss the payment of your Deposit in readiness for exchange of contracts.

Once contracts have been exchanged, the Completion date i.e. the moving date, is fixed and you will usually receive the keys from the Estate Agents by 2pm.

Following completion, we will arrange for the Stamp Duty, if any, to be paid and will deal with the registration of the Property into your name(s).
